Terms and Conditions of Internet Service

Service Reliability

RTDS NETWORK ICT SOLUTIONS INC. ("RTDS") strives to provide stable, high-quality, and reliable internet service. However, uninterrupted connectivity cannot be guaranteed due to factors beyond RTDS’s control, including but not limited to:

• Scheduled and unscheduled maintenance
• Power outages or fluctuations
• Technical failures or equipment malfunction
• Acts of nature or natural calamities
• Issues caused by third-party providers or network partners

RTDS shall exert reasonable efforts to restore service as quickly as possible in the event of disruptions.

Fair Use and Prohibited Activities

The Customer agrees to use the internet service responsibly and in accordance with RTDS’s Acceptable Use Policy (AUP).

The following activities are strictly prohibited:

• Sharing, redistributing, or reselling the internet connection to third parties
• Engaging in illegal, fraudulent, or malicious activities
• Uploading, downloading, or distributing content that violates laws and regulations
• Conducting activities that degrade or disrupt network performance or service quality
• Any attempt to breach network security or access unauthorized systems

Violation of this clause may result in immediate service suspension, termination, and/or legal action.

Limitation of Liability

RTDS shall not be liable for:

• Loss of data
• Damage to equipment
• Service interruption due to misuse, negligence, or external factors beyond RTDS’s control
• Indirect, special, incidental, or consequential damages

The Customer agrees to indemnify and hold RTDS free from any claim, damage, or liability arising from improper, unauthorized, or illegal use of the service.

Equipment Ownership

All equipment provided by RTDS (including modems, routers, ONU/ONT, antennas, or other devices) remains the property of RTDS unless fully paid for by the Customer.

Upon service termination, disconnection, or non-payment:

• The Customer must return all RTDS-owned equipment in good working condition.
• Lost, damaged, or unreturned equipment may result in corresponding replacement charges or legal action.

Installation and Activation

RTDS shall perform installation at the Customer’s premises based on agreed schedules. The Customer agrees to provide safe, unobstructed access to the installation area.

Installation fees, activation charges, and any additional materials required shall be shouldered by the Customer unless otherwise stated in a promo or agreement.

Billing and Payment

• Monthly service charges must be paid on or before the due date indicated on the bill.
• Late payments may result in temporary disconnection of the service.
• Reconnection fees may apply.
• All payments made are non-refundable.

Failure to settle overdue balances may result in permanent disconnection and legal collection efforts.

Service Suspension and Disconnection

RTDS reserves the right to suspend or disconnect service due to:

• Non-payment of dues
• Violation of the Terms & Conditions or AUP
• Fraudulent or suspicious activities
• Network interference caused by the Customer’s equipment

Service may be restored only after compliance with RTDS requirements and full settlement of outstanding balances.

Customer Responsibilities

The Customer agrees to:

• Keep the installation area safe and free from hazards
• Protect RTDS-owned equipment from damage, loss, theft, or tampering
• Notify RTDS of any change in contact information or relocation
• Use the service for lawful purposes only

Privacy and Data Protection

RTDS adheres to the Data Privacy Act of 2012. Customer information is collected, stored, and processed solely for service delivery and legitimate business purposes.

RTDS shall not disclose Customer data to third parties without consent, except when required by law.

Amendments

RTDS reserves the right to modify or update these Terms & Conditions at any time. Customers will be notified of significant changes through official channels.

Continued use of the service signifies acceptance of any updated terms.
